There's a subscribers-only podcast which Lesley Riddoch has put out (which unfortunately means I can't link to it), in which she interviews Sara Salayers.
Salayers points out that the Union with England Act, 1707 (linked) is specifically conditional (§XXV) on the Claim of Right Act, 1689 (also linked); and that the Claim of Right Act forbids government from prosecuting people on 'stretches of old... laws'.

Achtung Übersetzungsfalle!
Wegen dem im Einzelne doch etwas abweichenden Satzbau im Englischen und Deutschen ist bei der Übrsetzung des Deutschen Satzes:
Bevor war war war, war war ist
ins Englische zu beachten, dass das 2. und 3. "war" vertauscht werden müssen.
Die Englische Entsprechung heisst daher nicht:
Before was was was was was is
sondern
Before was was was was was is.
