There's a subscribers-only podcast which Lesley Riddoch has put out (which unfortunately means I can't link to it), in which she interviews Sara Salayers.
Salayers points out that the Union with England Act, 1707 (linked) is specifically conditional (§XXV) on the Claim of Right Act, 1689 (also linked); and that the Claim of Right Act forbids government from prosecuting people on 'stretches of old... laws'.
